I had a Voya variable annuity that was ready to be annuitized. The annuity was worth 190,000. I got to talking to a company called Annuity Advantage and the guy says he can get me my money with a 5 yr immediate annuity. It was only half so I lost 95,000 over 20 yr period. Is their a fiduciary or suitability responsibility on the agents part? He checked a box saying this was not taking the place of another annuity. Is this true because it was an indirect roll over?

Hi Rick,
You should immediately contact the new insurance company and explain what happened. This should have been considered an annuity replacement.
If your funds were nonqualified (the initial premium you used was already taxed for income) they should have been moved from your Voya annuity to your new annuity via a 1035 Exchange. This can cause several problems if it was not handled in this way.
If your funds were qualified (the account was considered an IRA, all funds were tax deferred) then it should still have been considered a replacement of one annuity for another.
Call your new insurance company and see what they advise.
